Welcome to www.aleph.vc (the “Site”). The Site is owned and operated by Aleph E.S. Management Ltd. (“Aleph”, “We”, “Our” or “Us”). Please read these Terms of Use (the “Terms”) carefully before using the Site. By accessing or using the Site or any of the content on the Site, you agree to be legally bound by these Terms. If you do not accept these Terms, do not use the Site. These Terms constitute the entire and only agreement between you and Aleph. We reserve the right to change these Terms at any time, effective immediately upon posting on the Site. Please check this page of the Site from time to time. If you violate these Terms, We may terminate your use of the Site and will be entitled to take appropriate legal action against you.

Permitted Uses.

By using this Site, you are granted a non-exclusive, non-transferable, revocable license to access and use the Site solely in accordance with these Terms, for internal, personal, non-commercial purposes. You undertake to use the Site only for lawful purposes. Unauthorized or unlawful use of the Site may give rise to a legal claim for damages against you and/or constitute a criminal offense. Intellectual property.

The content, organization, graphics, design, compilation, magnetic translation, digital conversion and other matters related to the Site are protected under applicable copyrights, trademarks and other proprietary (including but not limited to intellectual property) rights. Aleph reserves the right to investigate complaints or reported violations of there Terms and to take any action We deem appropriate, including but not limited to, reporting any suspected unlawful activity to law enforcement officials, regulators, or other third parties and disclosing any information necessary or appropriate to such persons or entities relating to your information such as your e-mail address, usage history, IP addresses and traffic information.

Termination.

Governing Law.

These Terms will be governed by and construed, interpreted and enforced in accordance with the laws of the State of Israel, without giving effect to any provisions that would require the laws of another jurisdiction to apply and regardless of your location.

No action arising out of these Terms or your use of the Site, regardless of form or the basis of the claim, may be brought by you more than one year after the cause of action has arisen (or if multiple causes, from the date the first such cause arose). The failure of Aleph to exercise or enforce any right or provision of these Terms will not constitute as a waiver of such right or provision. To the extent that anything in or associated with the Site is in conflict or inconsistent with these terms, these terms shall take precedence.

Disputes.

All disputes arising out of or related to these Terms or the subject matter of these Terms or any aspect of the relationship between you and Aleph under these Terms, whether based in contract, tort, statute, fraud, misrepresentation or any other legal theory, will be resolved through final and binding arbitration before a neutral panel of three arbitrators instead of in a court by a judge or jury and you agree that Aleph and you are each waiving the right to trial by a jury.

Any dispute arising out of or related to the Site will be brought in, and you hereby consent to exclusive jurisdiction and venue in, the competent courts located in the city of Tel-Aviv, Israel. YOU ACKNOWLEDGE AND AGREE THAT ANY CAUSE OF ACTION THAT YOU MAY HAVE ARISING OUT OF, OR RELATED TO, THE SITE MUST COMMENCE WITHIN ONE (1) YEAR AFTER THE CAUSE OF ACTION ACCRUES.
